The Opportunity: Our content attorneys collaborate with the brightest industry minds in the development, production, marketing and distribution of our cutting edge productions in scripted and unscripted series, features, documentaries, animation/anime, and kids and family programming. Counsel at Netflix operate as public-facing representatives of the company in the structuring of business deals and the negotiation and drafting of entertainment agreements, specifically agreements for the acquisition of rights and the engagement of creative professionals such as actors, writers, producers/production companies, composers and directors. On the intellectual property side of this role, the candidate will advise as to copyright issues, chain-of-title clearances, content production clearance, rights enforcement, claims handling, moral rights issues and defamation claims. The role is uniquely exciting and challenging in that it requires passion and curiosity for both domestic and international business and creative matters as well as the corresponding legal considerations that govern them. Counsel at Netflix tie business goals to strategy, extracting information from myriad sources, analyzing the various interests of the parties involved, proposing strategy, and collaborating with a wide variety of creative and business experts in order to achieve the desired results. Training:Netflix has developed the Legal Lab, a full-time, entry-level paid immersive and comprehensive training program designed to help qualified individuals transition to careers in content legal at Netflix. Following the completion of the Lab, the Counsel will be partnered to work in a hybrid, dual-capacity role that is focused on both (1) negotiating and drafting deals for content in a business and legal affairs capacity, and (2) intellectual property matters that arise throughout development, production, and launch of content on Netflix. Once the Legal Lab curriculum is completed, the candidate for this hybrid role will work on a broad range of issues relating to (1) business and legal affairs, and (2) intellectual property law in the film and television industry in Korea. The curriculum will include but not be limited to:- A detailed introduction to the filmed content landscape and its key players, including content producers, content distributors, talent representatives, unions, record labels and music publishers.- A deep dive into the chronology of filmed content production, including development, pre-production, principal photography, post-production, marketing and distribution.- A thorough exploration of entertainment industry fundamentals, including production finance, production tax, labor relations, and contract administration.- An in-depth curriculum built around intellectual property as it applies to the entertainment industry, and how matters such as trademark, copyright, defamation, invasion of privacy, or infringement of rights can arise in the context of making and distributing film and television for a global platform.- Advanced instruction and Q&A sessions with subject matter experts across a variety of disciplines, including creative development, physical production, music, security and safety, immigration, technology, and a host of others.- Advanced instruction in the nuts and bolts of negotiating and drafting a wide variety of entertainment agreements, including rights acquisition, writing, directing, producing, acting, intellectual property, and others. - Hands-on drafting assignments, simulations, workshops and quizzes based on both real-world deals and hypothetical business and legal scenarios.Responsibilities:- Negotiate and draft contracts with production companies, talent, and other parties involved in producing content, including contracts relating to complex and novel types of rights acquisition.- Identify IP-related risks in our content and help creative teams navigate them.- Collaborate with creative and business and legal affairs teams to acquire and develop IP, then shepherd it through production and distribution.- Help analyze trademark clearances, including multi-jurisdiction searches in collaboration with the trademark team.- Manage intellectual property claims in a pre-litigation stage.- Collaborate with litigation and public policy teams for litigation and regulatory work that involves IP issues.- Rapidly respond to production clearance issues and queries of the production houses and the creative team.- Develop and implement production clearance strategies for Korean content.- Conduct chain of title review for complex rights acquisition and provide concise and pragmatic analysis.- Negotiate and draft license agreements, release forms, and other contracts for a wide variety of production materials.- Collaborate with the marketing legal team to advise on IP-related issues in marketing and promotional content. - Work on creating innovative workflows/projects between IP and other teams to drive efficiency.Job Qualifications:- Thrive in a fast-paced collaborative environment, possess a high level of intellectual curiosity, focus on generating results, be comfortable evaluating risk with imperfect information, have the confidence to make quick decisions, and exhibit the highest personal and professional standards of integrity and ethics. - Be self-motivated, disciplined, highly organized and able to prioritize multiple tasks.- Understand and align with our unique business culture.- Possess strong written communication skills, with a passion for drafting language that is clear, precise, thoughtful, direct and refined.- Exhibit strong analytical capabilities and judgment, even when the rules are unclear and the issues are of first impression.- A law degree and a minimum of five (5) years of experience as a practicing attorney and registration in good standing as a lawyer in at least one jurisdiction.- Experience with Korean intellectual property law, including with respect to copyright, trademark, and litigation related to IP matters in Korea.- Fluency in Korean and English.Important Details:- Application deadline: September 30th, 2020- Early application is strongly encouraged due to limited program capacity. - Positions will be based in Seoul, Korea.Application Requirements:All applicants must submit a resume, along with a brief explanation of why they are interested in the role.
